Introduction

Welcome to PAYVPS By using our web hosting, VPS, or dedicated server services, you agree to be bound by the following terms and conditions. Please read these conditions carefully as they may affect your service offering. By using any services provided by PAYVPS LLC, you agree to be bound by the following Terms of Service. These terms constitute the entire agreement between you and PAYVPS LLC. Should you have any questions with the following services outlines, please contact us immediately.

Users and Customers of the Services provided by PAYVPS must accept the Terms and Conditions of Service set out below:

Transmission, storage, or presentation of any information, data, or material in violation of any state, or local law. This includes, but is not limited to, copyrighted material, threatening or obscene content, and material protected by trade secrets or other statutes.
Any activity that may damage PAYVPS LLC's servers or any other server on the internet.
Promotion of illegal activities.
You agree to indemnify, defend, and hold harmless PAYVPS LLC, its officers, directors, employees, from and against any and all claims, demands, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, brought by any third party.
If you violate any of the Terms of Service outlined in this agreement, and you fail to correct such violation within seven (7) days after receiving written notice from us, we have the right to terminate this agreement immediately.

Contents

If you are an individual customer of PAYVPS, these Terms of Service apply to anyone who gains access to our services through your account. You are responsible for the actions of all users who access our services using your account.

Legitimate Purposes: All services provided by PAYVPS must be used for legitimate purposes only.
Controversial or Offensive Content: You are responsible for any content or links hosted on our services that may be controversial, sexually explicit, or otherwise offensive to users.
Prohibited Content and Activities:

Content or activities that violate any laws, including copyright infringement, trademark violations, hate speech, phishing, pornography, online prostitution, human trafficking, fraud, and similar offenses.
Content or scripts that may interfere with the performance of PAYVPS servers.
Phishing attempts, which will be stopped immediately.
Domains used for phishing activities, which will be deleted or have their status changed to "Fraud".

Violation of this Contents usage may result in the suspension or termination of your PAYVPS services without refund.
Data Usage and Limitations

PAYVPS provides data traffic according to the specified limit in your service plan. If you exceed this data limit, your server will slowly (10Mb/s).
If you exceed your data limit, you will be advised to upgrade to a higher package or service plan to continue using our services without interruption.
Data traffic allotments on PAYVPS are not cumulative. Any unused data from one billing cycle does not roll over to the next period.
PAYVPS is not responsible for, and hereby disclaims any liability related to, data delivery errors or slow data traffic performance. We do not provide any guarantees or compensation for such issues.
It is your responsibility as the customer to monitor your data usage and upgrade your plan if needed to avoid service interruptions. PAYVPS reserves the right to suspend or terminate accounts that consistently exceed data limits without upgrading.

VPS Resource Usage Policy

Our VPS products operate in a shared environment. You may not use above 85% usage of all assigned vCPU cores continuously. vCPU usage allowance 85%-100% is permitted for up to 10 minutes (eg: After the initial 10-minute using 100% vCPU usage, our system will automatically evaluate vCPU usage for a defined period. If your usage has dropped back within normal limits, the restriction will be lifted, and you may again use 100% vCPU resources for future tasks.). If usage exceeds allowed limits vCPU usage, our system will automatically restart your VPS. If restart fails, we may power off the VPS.
Network usage limitation in a shared environment, excessive Packet Per Second (PPS) or bandwidth usage per second that impacts other customers will result in immediate suspension. To get unsuspension, let us know in ticket with your detailed explanation. This is applied only to abnormal network resulted from your VPS, ie: spike constantly and long-lived.

For resource usage details, you may open a support ticket, and we will provide graphs or statistics where available.

Data Backup and Responsibility

Users of PAYVPS services are solely responsible for performing independent data backups to ensure the security and recoverability of their data. PAYVPS does not provide automatic or included data backup services as part of our core hosting offerings.
If a user requires regular, reliable data backup capabilities, we recommend subscribing to a separate backup service provider. PAYVPS can provide recommendations for third-party backup solutions upon request.
While PAYVPS does maintain internal backups of server data for our own operational purposes, these backups are not intended for user recovery. The contents and availability of these internal backups are not guaranteed and should not be relied upon by users.
PAYVPS provides a snapshot feature within our server management control panel, which allows users to create your own manual server snapshots. These snapshots are stored on the user's server and can be used for data restoration purposes. However, the user is responsible for managing and maintaining these snapshots.
PAYVPS shall not be held responsible for any data loss, corruption, or damage that may occur while using our services. Claims for compensation related to data loss are not covered, as data backup and protection is the sole responsibility of the user.

Billing Policy

PAYVPS does not provide any refunds once a customer's server or service has been provisioned and activated. By placing an order and proceeding with service activation, the customer acknowledges and agrees that all fees paid are non-refundable.
While we do not offer refunds, customers are free to cancel their PAYVPS services at any time. Cancellation will result in the termination of service at the end of the current billing cycle, but no partial refunds will be issued.
PAYVPS services are billed on a recurring basis, either monthly, quarterly, semi-annually, annually, biennially, or triennially, depending on the plan selected by the customer. Payments are due in advance for each billing cycle, and no refunds will be provided for unused service time.
The only exceptions to our no refund policy are in cases where PAYVPS is unable to provision the ordered service within a reasonable timeframe or if there is a verified service outage that exceeds our published uptime guarantees.
By placing an order for PAYVPS services, the customer acknowledges and agrees to this Refund Policy. Customers are advised to carefully review the service details and plan options before finalizing their purchase, as no refunds will be issued after activation.

Privacy Policy

Registration and Account Information: When you create an account with PAYVPS, we collect your name, email address, and other relevant contact details.
Billing and Payment Information: For customers who subscribe to our services, we collect payment information such as credit card details or bank account numbers to facilitate the billing process.
Usage and Activity Data: We may collect information about your usage of our services, including the servers and resources you access, the frequency of your visits, and your interactions with our website and support channels.
Providing and Maintaining Services: We use your information to set up and manage your PAYVPS account, provide the services you have requested, and respond to your inquiries and support requests.
Billing and Account Management: We use your billing and payment information to process payments, manage your account, and keep track of your subscription and usage.
Improving Our Services: We may analyze usage and activity data to better understand how our customers use our services and to make improvements to our offerings.
Communications and Marketing: We may use your contact information to send you updates, announcements, and other communications about our services, as well as to inform you about new products or services that may be of interest to you.
PAYVPS takes the security of your personal information very seriously. We implement industry-standard security measures, such as encryption, access controls, and regular backups, to protect your data from unauthorized access, modification, or deletion.
We will retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by applicable laws and regulations. You have the right to request the deletion of your personal information, and we will comply with such requests to the extent permitted by law.
PAYVPS may share your information with third-party service providers who assist us in operating our business and delivering our services, such as payment processors or technical support providers. We ensure that these third parties maintain appropriate security and privacy measures.

PAYVPS reserves the right to update this Privacy Policy from time to time. Any changes will be posted on our website, and we encourage you to review this policy periodically to stay informed about how we are protecting your information.
Service Legal Agreement

PAYVPS guarantees a 99% uptime for all our hosting services, calculated on a monthly basis. This means that your services should be available and accessible for at least 99% of the time in any given month.
In the event that your service experiences downtime resulting in less than 99% uptime in a given month, you may be eligible to receive an extension of your service for additional at no cost. Please note that certain events may not be eligible for the service extension, including:
- Downtime caused by issues with our upstream providers, such as network outages or service disruptions
- Distributed Denial of Service (DDoS) attacks
- Scheduled maintenance or upgrades
- Hardware failures or replacements
- Network issues outside of our direct control
PAYVPS provides DDoS protection for our hosting services. While we strive to mitigate the impact of DDoS attacks, we cannot guarantee any specific level of protection. In the event of a DDoS attack, we will take necessary actions to maintain the stability and performance of our network, which may include temporarily null-routing the affected IP address.

PAYVPS reserves the right to update this Service Level Agreement from time to time. Any changes will be posted on our website, and we encourage you to review the SLA periodically to stay informed about our service commitments and policies.
Uptime Guarantee & Remedies

We provide a 99% uptime guarantee, measured monthly.

Exclusions: Scheduled maintenance, force majeure, misconfiguration by PAYVPS staff, third-party failures, Upstream, DNS, or routing issues outside PAYVPS control, DDoS attacks or other abuse directed at a customer.

Remedies: If uptime falls below guarantee, you may request a service extension of service time within 7 days of the incident. One hour (60 minutes) downtime equals to 1 day extension.

Miscellaneous

This Agreement shall be governed by the laws of the Singapore government.
Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration.
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral.
